These Terms of Service ("Terms") govern all services provided by VirtuaHost ("we", "us", "our"). By creating an account, purchasing a service, or using any VirtuaHost system, you agree to these Terms in full.

We may offer further services (such as dedicated or game servers) in future; they will be covered by these Terms when they are available.
You are responsible for:
We may suspend or terminate an account if we reasonably believe it has been compromised.
We will only access the contents of your server where you ask us to (for example when helping you with console or rescue access) or where we need to investigate a suspected breach of the AUP, as set out in the AUP.
All services must be paid for in advance unless explicitly agreed otherwise. Failure to pay may result in:
Renewal payments are automatically processed unless you cancel the service beforehand. Refunds are governed by our Refund Policy.
If you are a consumer, you normally have the right to cancel your order within 14 days without giving a reason (the "cooling-off period"), under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
However, our VPS and hosting services are provisioned and made available to you immediately upon successful payment. At checkout, you will be asked to expressly confirm that you want your service to begin immediately, within the 14-day cancellation period. If you provide this confirmation:
This does not affect your right to a refund or replacement if the service is faulty or not as described, under the Consumer Rights Act 2015. Full details are set out in our Refund Policy.
VirtuaHost reserves the right to modify service pricing at any time. Where a pricing change affects your active services, we will provide a minimum of 30 days' written notice via email before the new price takes effect. Continued use of the service after the notice period constitutes your acceptance of the updated pricing. If you do not wish to continue at the new price, you may cancel your service before the change takes effect in accordance with our Refund Policy.
All customers must comply with our Acceptable Use Policy (AUP).

Unless you have the Daily Backup Pack add-on on a service, that service is not backed up by us and you are solely responsible for keeping copies of your data.
With the Daily Backup Pack, we take an automatic backup of your server each day and keep the last 7 days of backups, stored encrypted on separate storage. Backups are made on a best-efforts basis, and we cannot guarantee that every backup will be successful or that a restore will recover all of your data. To restore a backup, open a support ticket. You remain responsible for keeping your own copies of important data.
VirtuaHost is not liable for data loss arising from your actions, software faults, hardware failure, or termination.
We strive to maintain high service availability. Scheduled maintenance will be communicated where possible.
We do not currently offer a Service Level Agreement or a guaranteed level of uptime. If that changes, the terms will be set out in a separate agreement.
We may suspend or terminate services if you:
Where we suspend or terminate a service because of a breach of these Terms or the AUP, we may do so immediately and without notice if the breach is serious, as described in the AUP, and no refund or credit will be due.
When a service is cancelled or terminated, its server and data are deleted and cannot be recovered. Backups of a deleted service are deleted within 30 days.
To the fullest extent permitted by UK law, VirtuaHost is not liable for:
Our total liability is limited to the amount paid by you for the service during the previous 12 months.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded or limited under applicable law.
You agree to indemnify VirtuaHost against claims arising from your use of the service, violation of the Terms, or breach of applicable laws.
We may update these Terms periodically. Continued use of our services indicates acceptance of the revised Terms.
These Terms are governed by the laws of England and Wales. Any disputes shall be heard exclusively in the courts of England and Wales.
